The "Measures for the Protection of Electric Power Facilities in Qinghai Province" has been reviewed and approved at the 32nd executive meeting of the Provincial People's Government on April 15, 2005. It is hereby promulgated and will be implemented as of June 10, 2005.

Article 1 In order to maintain public safety and ensure the smooth progress of power production and construction, these Measures are formulated in accordance with the Regulations on Protection of Electric Power Collision (hereinafter referred to as the Regulations) and relevant state regulations, in conjunction with the actual conditions of the province.

Article 2 These Measures apply to the protection of power facilities built or under construction in the province.
The power facilities referred to in these Measures include: power generation, substation, transmission, distribution facilities and their auxiliary facilities, and power dispatching communication facilities.

Article 3 The protection of electric power facilities shall adhere to the principle of prevention-oriented and comprehensive management, and implement the principle of combining electric power administrative departments, public security organs, electric power enterprises and the people.

Article 4 The people's government at or above the county level shall strengthen the organization, coordination and leadership of the protection of power facilities.
Public security organs at all levels shall strengthen the safety protection of power facilities, and promptly investigate and deal with cases of theft, destruction of power facilities and the looting of power equipment.
The departments of transportation, water conservancy, forestry, construction and land and resources at or above the county level shall assist the power administrative departments at the same level and the public security organs to protect the power facilities within the scope of their duties.

Article 5 The provincial electric power administrative department shall be responsible for the protection, supervision and management of electric power facilities within the administrative district, and organize and coordinate the people at or above the county level in accordance with Article 3 of these Measures and the Regulations for the Implementation of the Regulations on the Protection of Electric Power Facilities (hereinafter referred to as the Detailed Rules). The government's power administrative management department has established a long-term mechanism to protect power facilities.
The power administrative department at or above the county level shall perform the following duties;
(1) Carrying out publicity and education activities for the protection of electric power facilities, promoting technical preventive measures for the protection of electric power facilities, and improving the ability of electric power facilities to resist external damage;
(2) Establishing a line of responsibility for the protection of the masses and the line of protection of the line and the relevant units along the power line and the power line to train the line guards;
(3) Conducting inspecting and rectifying the hidden dangers of hazardous electrical facilities on a regular basis and discovering violations of the regulations, rules and these Measures, and promptly investigate and deal with them according to law;
(4) Establishing a reporting system for theft and destruction of power facilities, publishing the report telephone number and communication address, accepting public reports, and promptly investigating and handling reported cases with relevant departments;
(5) Coordinating the safety of power facilities and other facilities;
(6) Assisting local public security organs in investigating public security and criminal cases that damage power facilities in the areas under their jurisdiction;
(7) Establishing signs on the boundary of the necessary overhead power line protection areas, such as dense population, frequent vehicle crossing, and vulnerability to external forces, indicating the protection area and protection regulations.

Article 6 The people's governments at or above the county level along the power line shall incorporate the prevention and control of theft and destruction of power facilities into the comprehensive management of public security.
The township (town) people's government, village (residential) committees, enterprises and institutions along the power line shall support the electric power administrative department, organize the masses to do the protection of electric power facilities, select the line guards, and carry out mass escort activities.

Article 7 Electric power enterprises shall strengthen the protection of electric power facilities, establish and improve the working system for protecting electric power facilities, improve the prevention technology for protecting electric power facilities, and regularly conduct inspections, maintenance and overhaul of the electric power facilities under management.
No unit or individual may interfere with or hinder the inspection, maintenance and overhaul of power facilities by power companies and their staff.
The power enterprise has the right to stop the acts that endanger the safe operation of the power facilities. If the damage is caused, the infringer may be required to remove the obstacles, restore the original condition, and compensate for the losses.

Article 8 Any unit or individual has the obligation to protect power facilities and has the right to stop acts that endanger the power facilities and report to the power administrative department or the public security organ.

Article 9 The scope of protection of power facilities such as power generation, substation, transmission and distribution shall be determined in accordance with the provisions of Articles 8 and 9 of the Regulations, and any unit or individual shall abide by them.

Article 10 The protected areas of overhead power lines in general areas shall be determined in accordance with the provisions of the Regulations. In the overhead power line protection areas of densely populated areas such as factories, mines, towns, villages, etc., the horizontal safety distances from the building (structure) are calculated as follows:
(1) 1 kV to 10 kV not less than 1.5 m;
(2) 35 kV not less than 3.0 m;
(3) 110 kV not less than 4.0 m;
(4) 330 kV not less than 6.0 m;
(5) 750 kV shall be implemented in accordance with relevant state regulations.

Article 11 No unit or individual may engage in the following acts that endanger power generation, power transformation, or dispatching communication facilities:
(1) moving, damaging or altering power generation, substation, dispatching communication facilities and their markers;
(2) Safe operation of pipelines (ditches) that endanger water, oil, heat, gas and ash;
(3) climbing the substation facilities without authorization, or using the substation facilities to squat livestock, hang objects, post advertisements, etc.;
(4) carrying out operations that endanger the safety of power generation and substation facilities in the underground of power generation facilities and substation facilities;
(5) Engaged in activities that endanger the safety of substation facilities outside the substation wall.

Article 12 No unit or individual may engage in the following acts that endanger the construction of electric power facilities and the order of electric power production:
(1) Entering the power engineering construction site to disturb the construction, alteration, movement, damage to the construction of the electrical facilities and the measurement of the standard piles and markings
(2) Invading the land acquired for the construction of electric power facilities, destroying the blocked construction road, and cutting off the construction water source or power supply;
(3) Disrupting the operation and management of power plants, substations, power production supply command and dispatching agencies.

Article 13 Any unit or individual may not engage in the following acts that endanger the power line facilities:
(1) climbing or crossing safety protection devices, towers and related auxiliary facilities of power line facilities;
(2) Taking soil, digging sand, quarrying, piling, drilling or other excavation operations in the basic protection zone of the power line tower or cable, constructing structures, stacking or burning grain, forage, wood and Flammable and explosive materials such as oil, dumping, discharging garbage, slag, construction waste or chemical waste corrosive substances such as acid, alkali, salt, and other wastes;
(3) Hanging advertisements, slogans, clothes ropes and other objects on power lines, towers and auxiliary facilities;
(4) quarrying, borrowing or performing other excavation operations in the underground power cable line protection area, or planting trees that endanger the safety of electric power facilities;
(5) Handling high poles or conductive materials that do not meet safety requirements or carrying out other activities that endanger the safety of power facilities under overhead power lines, or planting trees or other plants that endanger the safety of power facilities in their protected areas;
(6) Move and disassemble the pole pull rod and pull wire.

Article 14 After approval by the power administrative department at or above the county level and taking corresponding security measures. You can engage in the following activities:
(1) Carrying out farmland water conservancy basic construction projects and piling, drilling and excavation operations in the overhead power line protection zone;
(2) The hoisting machinery enters the construction of the overhead power circuit protection zone;
(3) Vehicles or machinery (including loads) exceeding the safe height of 4 meters are practised through overhead power;
(4) Non-electric lines such as communications, radio and television, and overhead power lines are erected on the same pole;
(5) Conducting activities such as wiring, overhaul, etc. that may endanger the safe operation of power facilities in the power facility protection zone.

Article 15 Only after the power company has agreed and takes corresponding security measures can the following activities be carried out:
(1) arranging lines or setting up other facilities on power line facilities due to performances, screenings, and gatherings;
(2) Personnel and vehicles do need to pass through the power plant dam.

Article 16 Within 500 meters around the power facilities; blasting operations are prohibited. Where blasting operations must be carried out due to work requirements, reliable safety measures shall be taken in accordance with the laws and regulations promulgated by the State concerning blasting operations; and the written consent of the owner of the power facilities shall be obtained and reported to the relevant administrative department for approval.

Article 17 Units or individuals that purchase used electrical power facilities and equipment, when purchasing used electrical power facilities and equipment, must truthfully register the name, address, identity card number and source of the goods sold by the seller or manager of the used electrical power equipment. , name, quantity, specifications, etc.

Article 18 The competent departments of urban and rural planning shall incorporate plans for the construction, reconstruction or expansion of electric power facilities into urban and rural construction plans when preparing urban and rural construction plans. When the competent department of urban and rural planning approves or plans to build new buildings on both sides of the power facilities, it shall solicit the opinions of the local power management department.

Article 19 When it is necessary to damage crops or cut down trees due to the construction, reconstruction or expansion of power facilities, the owner shall be compensated once in accordance with relevant state regulations. ,
After the construction project is approved, the construction unit shall conduct physical investigation and registration of the forests and buildings (structures) of the landowners and users. Landowners and users will not be compensated for the trees that have been plucked after physical registration and the buildings (structures) that have been built.
If the construction of electric power facilities does require the cutting of trees, the construction unit shall go through the examination and approval procedures to the forestry department or relevant competent authorities according to law.

Article 20 When electrical facilities and buildings and other facilities interfere with each other, they shall be dealt with according to the following provisions;
(1) After the construction of other facilities in the power facilities, the safety of the power facilities shall not be jeopardized. If the special needs must be transferred to the original power facilities, the necessary protective measures shall be taken and a transfer compensation agreement shall be signed with the owner of the power facilities;
(2) After the construction of electric power facilities in other facilities, it shall comply with the provisions of relevant laws and regulations, and shall not cross the area where the warehouses for burning or explosive materials are stored. Due to special conditions such as geographical conditions and outlet restrictions, it is necessary to cross the houses according to The provisions of Article 15 of the Rules shall be dealt with:
(3) When the underground power cable and other underground pipeline facilities need to cross through, the double-playing units shall negotiate and sign an agreement, and take safety measures before construction;
(4) If the original building (construction) is not in compliance with the requirements for the safety distance protection of the power facilities, the change party shall promptly rectify the damage, and the damage caused by the change shall be borne by the change party.
When power facilities interfere with public facilities, urban greening or other trees, they are dealt with in accordance with Article 16 of the Rules.

Article 21 The power administrative departments at or above the county level shall give incentives to units and individuals that have made outstanding contributions to the protection of power facilities to 2,000 yuan or less; those who make significant contributions may be awarded more than 2,000 yuan.
Units and individuals that have made significant contributions to the protection of power facilities, except for material rewards, may be commended by the power administrative department, the public security organ or the people's government at or above the county level in accordance with the relevant provisions of the State and our province.

Article 22 Anyone who violates the provisions of these Measures and who is punished by laws or regulations shall be prescribed by him.

Article 23 Anyone who violates the provisions of Articles 11, 13 and 17 of these Measures shall be ordered to make corrections by the electric power administrative department at or above the county level, and those who refuse to make corrections shall be fined not less than 200 yuan but not more than 5,000 yuan.

Article 24 In violation of the provisions of Article 14 of these Measures, if the power administrative department does not agree or fails to take safety measures, the power administrative department at or above the county level shall order it to stop the harmful behavior and restore the original condition; causing personal injury or property. If the loss is caused, the responsible person shall bear the compensation for the responsibility according to law.

Article 25: Robbery, theft, destruction of power facilities or disruption of power production order in violation of the law on public security administration,
Public security organs shall give public security management punishment according to law; if they constitute a crime, they shall be investigated for criminal responsibility according to law.

Article 26 If, in violation of the provisions of these Measures, personal injury or property damage is caused by damage, theft or endangering the power facilities, the responsible person shall be liable for compensation according to law.

Article 27 If a staff member of the power administrative department violates the provisions of these Measures and has abused his power, neglects his duty or conducts a customary fraud, the supervisor or other directly responsible personnel directly responsible for the administrative organ at his superior level or his or her unit Administrative sanctions shall be given according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 28 These Measures shall come into force on June 10, 2005.
